Code Citations — Did you miss our meeting?

Turnout at Josephine County Democrats’ March 2022 meeting was at a nearly pre-pandemic level as people turned out to listen to county officials discuss Ordinance 2021-002. The Ordinance, passed late last year by the Board of Commissioners, was aimed at discouraging illegal cannabis grows by beefing up code enforcement in the county. The ordinance calls for fines of up to $500 a day for violations of county building codes, including structures raised without permits. However, after the ordinance was approved, petitioners objecting to it as a violation of their property rights got it on the May ballot.

    I support the code enforcement for illegal grows but the $500 fine per day for code violations should not apply to the illegal grows as all structures/areas should be destroyed since it is “illegal.” Could someone explain why the County thinks they have the right to come on anyone’s property without notice and start fining residents? Why is this part of an ordinance addressing illegal grows? I agree all residents should follow permitting and code rules or ordinances but I certainly don’t believe the County has a legal, constitution right to enter a private citizen’s property without due notice. Even the tax assessor cannot enter your home without your permission.

      I believe if you watch the entire presentation, you will find that the County will not have a right to come on anyone’s property without notice at any time. You must have heard that elsewhere. I recommend that you watch the entire presentation and read the ordinance. Can also contact Mark Stevenson at planning@josephinecounty.gov.
